Interlocutory Papers

In 2019, Tiger Brands subpoenaed various parties including laboratories, auditors and vendors. The purpose of these subpoenas are largely to request test results, records and protocols relating to all Listeria samples collected from facilities, and communication concerning Listeria from various governmental departments and international agencies. Much of the content of these requests are, in the view of the class attorneys, irrelevant fishing expeditions, without relevance to the main action. Various subpoenaed parties have resisted the subpoenas, resulting in various applications to set aside the subpoenas, and applications to compel compliance with the subpoenas, since July 2019. RSI successfully applied to intervene in the interlocutory application in November 2019.
